What exactly happened? 

T-Mobile has agreed to a class action settlement worth nearly $500 million. T-Mobile has agreed to pay $350 million to settle the class action claiming data breach that affected 76 million Americans. As part of the Settlement, T-Mobile also committed to $150 million investment in data security and related technology in 2022 and 2023.

T-Mobile revealed in August 2021 that it had suffered a data breach that exposed the personal information of current, former, and potential customers. While no financial data was compromised, names, addresses, dates of birth, identification information, and even some Social Security numbers were exposed in the hack.

T-Mobile CEO Mike Sievert admitted in the data breach announcement that the company “didn’t live up to the expectations we have for ourselves to protect our customers.”

Almost immediately, customers began filing lawsuits against T-Mobile, claiming the company had broken its promise to protect their personal data. According to the plaintiffs, T-negligence Mobile’s allowed the data breach to occur when reasonable cybersecurity measures could have prevented or mitigated the damage.

What’s the offer?

Class members are eligible for compensation of up to $25,000. This amount represents the maximum amount that can be awarded for members’ actual out-of-pocket expenses. This includes up to 15 hours of lost time at a rate of $25 per hour, or class members’ documented hourly wage if they took time off work, as well as payments for credit monitoring, identity theft, fraud, and other expenses.

A cash payment of $25 or $100, depending on whether you were a California resident on August 1, 2021, is available to class members who do not want to file claims for lost wages or other expenses.

Each class member is eligible to receive Pango’s identity protection services for two years at no cost. These features include identity theft insurance of up to $1 million, monitoring of dark web and transaction activity, monthly credit scores provided by TransUnion, and so on.

Class members who fall victim to identity theft or fraud as a result of the data breach will receive additional restoration services as part of the settlement.

The last date to make any exclusions or objections is December 8, 2022.
T-data Mobile’s breach settlement final approval hearing is set for January 20th, 2023.
You must submit your claims by January 23, 2023, to be eligible to receive settlement benefits.


Who can make a claim? 

T-Mobile found that the T-Mobile Data Breach put the information of 76 million U.S. residents at risk. All of these consumers are eligible to be Settlement Class Members. If you received a Settlement notice, you are likely a Settlement Class member.

What are the claims one could make against T-Mobile?

Class Members can make the following claims depending upon their experience:  

  • Out-of-Pocket Losses and Lost Time: If you spent money to avoid or recover from T-Mobile Data Breach-related fraud or identity theft, or to protect yourself from future harm. You may make a claim for up to $25,000, including a claim for Lost Time. You will, however, need to provide “Reasonable Documentation” supporting a claim for Out-of-Pocket Losses.
  • Cash Payment for Lost Time: If you spent time to remedy or prevent any effects of the Data Breach on or after August 1, 2021, you may make a claim for Lost Time. You may be reimbursed at your documented hourly wage if you took time off work. Or you may claim the Reimbursement Rate of $25 per hour. To make a claim for Lost Time, you will have to provide detailed account of time spent on each relevant activity. You may receive compensation for up to 15 hours for Lost Time related to Out-of-Pocket Losses. While for Lost Time not related to Out-of-Pocket Losses, you may be compensated for up to 5 hours.
  • Alternative Cash Payment: California residents who don’t make a claim for Lost Time or Out-of-Pocket Losses, can make an Alternative Cash Payment claim. Each claimant may receive $25 to $100 as an Alternative Cash Payment. This amount, however, may change depending on the total number of valid claims.
  • Identity Defense Services: The Settlement helps safeguard your personal data. Settlement Class Members can claim two years Identity Defense Services from Pango for free. This includes an Identity Theft Insurance of up to $1 million. You can make this claim in addition to any of the above claims.

Are you qualified to make a claim?

You are qualified to make a claim if:  

  • You were a T-Mobile consumer on or before August 2021 who was affected by the data breach.
  • You received a Settlement Notice about the T-Mobile Data Breach Settlement.
  • You file a claim by January 23, 2023.  

How can you make a claim?  

If you received the Settlement Notice with your Unique Class Member ID, you can submit a claim on the official settlement website. Alternatively, you may download the paper claim form and send your completed form via mail.
