Cool settlement vouchers for buyers of Costa Plano Sunglasses…  

Did you buy one or more pairs of Costa del Mar Plano sunglasses between 2013 and 2018? Did you pay any warranty fees for those sunglasses? And then, when your sunglasses got damaged, did you pay for the repair or replacement as well?
Well, if you did, you may be eligible to receive a settlement or product voucher worth anything between $8.99 to $19.99.

What exactly happened? 

A man named  Troy Smith sued Costa del Mar in Jacksonville, Florida (Smith v. Costa del Mar 3:18-cv-1011-J-32JRK). Smith complained that he, and others like him, were charged a warrantee fee by Costa del Mar when they purchased their Plano sunglasses. This warranty fee was supposed to cover the expense of repairing or replacing the sunglasses when these were damaged by misuse, by accident or by ordinary wear and tear.  

Smith claimed that they should not have been made to pay warranty fees for repairs. The same should have been covered by the company’s warranty. The customers did not need to pay for the warranty since the company offered a Lifetime Warranty on their sunglasses.

Without admitting that they made a mistake or did wrong, Costa del Mar agreed to settle the case. Their offer of settlement will be reviewed by the court in a fairness hearing on April 1, 2021. During the fairness hearing, the court will decide whether to approve the proposed settlement or not.


What’s the offer?

Costa Del Mar Inc. of Florida offered to pay $40 million in product vouchers to qualified claimants. Then, they will shoulder the shipping & handling on the purchases made using the product vouchers. In all, Costa Del Mar will settle the claim for a total of $60 million in settlement benefits.  

You can use the product vouchers to purchase items for sale as of the “date of use” appearing on the Costa Del Mar website. When you use the vouchers to purchase Costa products, you will not need to pay sales tax or shipping & handling fees. The product vouchers expire within two years of issue.

Who can make a claim? 

There are four groups that can make a claim in the settlement.  

  1. The first group of claimants is the Florida Purchase Class. It is for citizens of Florida who purchased Costa Plano sunglasses in Florida from July 28, 2013 until January 31, 2018. Each of them gets a $10 voucher.
  1. The second group of claimants is the Florida Repair Class. It is for those citizens of Florida who purchased Costa Plano sunglasses  between July 28, 2012 and January 1, 2018; and were charged a fee to repair or replace their damaged sunglasses. They will each get a $19.99 voucher.  
  1. The third group of claimants is the Nationwide Repair Class. It is for all citizens of all other states in the US except Florida, who purchased Costa Plano sunglasses before January 1, 2018. And paid the warranty fee and still paid the repair fee for their sunglasses  after April 3, 2015. They will also get a $19.99 voucher each.  
  1. The fourth group is the Warranty Class. It is for all US citizens who purchased nonprescription Costa sunglasses before January 1, 2016 and paid warranty fees anytime since August 20, 2013. They will each get a $8.99 voucher.

Are you qualified to make a claim?

You are qualified to make a claim if:  

  • You purchased Costa Plano sunglasses before January 1, 2018 OR if you purchased Costa nonprescription sunglasses before 2016; and
  • You were charged a warranty fee on your purchase; and
  • You paid a repair fee when you had your sunglasses repaired; and
  • You file a claim by January 31, 2021.  

How can you make a claim?  

You can make a claim by filling up a claim form on the settlement website. You can claim vouchers for as many Costa Plano products, covered under this settlement, that you purchased.  

Once you’ve filled up the form, email the form to

Make your claim by January 31, 2021. 
If you email the Claim form, it must be emailed on or before January 31, 2021.
If you send the claim form by snail mail, it must be post-marked on or before January 31, 2021 to be included.

  • Attestation that the claim is true and correct
