iPhone Class Action Settlement

Has your iPhone lost its smarts? You might be eligible to file a claim. 
Apple, in a class action settlement, has offered to pay up to $500 million.

Did you own a US-bought iPhone 6, 6 Plus, 6s, 6s Plus or an iPhone 7 or 7 Plus before December 21, 2017? Did that device receive an updated software known as  iOS 10.2.1 or 11.2? And did your phone crash, freeze or suffered diminished performance in any way? If so, you might be eligible to make a claim for the settlement. Apple will pay anywhere from $310,000,000 million up to $500,000,000.00 million to all qualified iPhone owners. Although the deadline for filing these claims has ended on October 6, 2020.  


What are the allegations against Apple?

Some iPhone owners in the US sued Apple because the software updates by Apple diminished their phones’ performance. Those cases were consolidated (heard together) because the claims of the iPhone owners were similar. The combined lawsuits created a class suit – a suit brought by a few people as representatives of all iPhone owners who may have suffered diminished performance on their phones because of the same software update.  

The court has not yet decided the case but Apple has made an offer of settlement and the people who brought the suit have agreed to settle. The settlement will avoid an expensive trial. Instead of spending on a trial, the money will go to qualified claimants.

The name of the class suit is: 
In re Apple Inc. Device Performance Litigation
Case No. 18-MD-2827-EJD United States District Court for the Northern District of California.  


Which devices’ owners are eligible?

The owners of the following US-owned or purchased iPhone devices are eligible to make a claim for this settlement: 

  • iPhone 6, 6 Plus, 6s Plus that ran on iOS 10.2.1 
  • iPhone 7, 7 Plus that ran on iOS 11.2 

These devices must have been purchased or leased before December 21, 2017.


Am I an eligible class member? 

If you bought your iPhone in the US and you are a resident of the US, its territories or its possessions, you are eligible. For your claim to be allowed, along with your device being eligible under this claim, you must be an eligible class member as well.  


How much did Apple offer as settlement?

Depending on the number of eligible claimants, Apple has agreed to make cash payments of $25- $500 for every eligible device. Accordingly, Apple has offered to pay a total of $310 million up to $500 million.  


What kind of information will you need to provide?

You will need to provide the following information on the claim form: 

  1. Personal details and contact number. Prepare to give your name, street or mailing address, email address and contact number. You may also have to provide the name and routing number of your bank and your bank account number.
  1. Details about your device. You must know your device’s serial number.  
  1. Details of the diminished performance. You must describe how your phone’s performance suffered because of this update.  

You would have to sign the claim form and declare under oath the truthfulness of this information provided above.


How long before I receive the settlement amount?

The final hearing is on December 4, 2020. Wherein the court will decide to approve or reject the settlement. Either party may file an appeal against the same. In case no such appeals are filed, the eligible claims will be processed and the settlement benefit will be sent to you.


How will I receive the settlement payment?

The online claim form provides instructions on how you want to receive the payment. You can receive payment electronically by ACH.  You will be asked to give the name of your bank, your bank’s routing number, and your bank account number.
