A $19.5 million Class Action Settlement to compensate consumers who purchased certain Baby Formula products by Abbott Laboratories.

What exactly happened? 

Consumers filed a class action lawsuit against Abbott Laboratories, for False Advertisement allegations. Basically, the complaint claimed that Abbott Laboratories baby formula products do not make as much liquid formula as advertised. Plaintiff Hannah Ramsey-Standage, with Kara Rutenbar Hatmaker, and Rita De Lao, seek to represent a Class of all individuals who purchased Defendant’s products.

Similac Pro-Sensitive Front Label

Defendant boldly states on the front label of the Products that they can be used to create a large number of extra bottles of formula. For instance, here’s the front label of Defendant’s Similar Pro-Sensitive. On the top-right corner, it says, “Makes 13 More” fluid liquid oz.

The product’s back label also states similar claims. It also depicts the “Mixing Guide” or the Directions of Preparation and Use.

The back label of Defendant’s Similac Pro-Sensitive claims that it “makes approx. 225 fl oz of formula” when mixed as directed.

However, the complaint alleges, that Defendant’s products contain much lesser quantities of the powder than their claims. The Complaint referred to an independent analysis of several of Defendant’s products. Which found that some of Defendant’s products contained as much as 15% lesser than what they advertised.

Therefore, the complaint alleged, consumers were injured and denied the benefit of the bargain when they bought the Products.

Abbott Laboratories denies the lawsuit’s claims that it violated the law or caused harm. Abbott Laboratories claims that its Labeling and marketing are truthful and accurate, and its Products yield the number of 4-ounce bottles of liquid formula on the Label. However, Defendant agreed to the Class Action Settlement to avoid further litigation and business disruption.

What does the Settlement offer to the consumers?

As a part of the Settlement, Abbott Laboratories has agreed to the following terms:

  • Business Practises: To make changes to the Label on certain Products.
  • Individual Claims: To pay claim amounts to the eligible Class Members with, or without, Proof of Purchase.
  • Claims without Proof of Purchase: You can get up to $3 per Unit purchased, up to a maximum of $15 per Household; Or
  • Claims with Proof of Purchase: You can get up to $3 per Unit purchased for which a valid Proof of Purchase has been provided, up to a maximum of $45 per Household.

Any individual can only make one of these two claims.

You must submit your claims by 11:59 p.m. Central Time on January 31, 2023, to be eligible to receive settlement benefits.


Who can make a claim? 

Anyone who purchased any of the specified Abbott Laboratories Products (for personal use only) between June 24, 2016, and September 22, 2022, can make a claim.

How can you recover money from this Settlement?  

To make a claim to recover money from the settlement, you must submit a Claim Form. You can only make one type of claim, either with proof, or without proof.

The easiest way to make a claim is to submit a claim online. To make an online claim:

  • Fill up the Registration Form on the Official Settlement Website as a Class Member here. You will receive a Class Member ID upon successful registration.
  • Use the Unique Member ID to submit an online claim here.
  • Please make sure to provide relevant documents, like purchase invoice, for a Claim with Proof.

Alternatively, you may download a Claim Form here. Your Claim Form must be signed under penalty of perjury. All claims must be postmarked, or submitted online, latest by 11:59 p.m. Central Time on January 31, 2023.

If you do nothing and the Settlement is approved, you forever waive your right to sue Abbot Laboratories and the Released Parties for the Claims this Settlement resolves.
