Traveler’s Data Breach

If you or a loved on is a customer of Traveler’s insurance, a recent class action alleges that they are liable for a data breach.

On October 27, 2022 Judge Vincent Briccetti denied Traveler’s Insurance attempt to dismiss the putative class action case alleging that Traveler’s insurance should be liable for a data breach.

Plaintiff Jennifer Rand brought this case since a data breach made available the Plaintiff’s personal identifying information to non-party cybercriminals.

Cybercriminals were targeting Instant Online Insurance Quote Websites

On February 16, 2021 and on March 30, 2021 The New York State Department of Financial Services (NYSDFS) issued cybersecurity fraud alerts warning regulated financial institutes like Travelers that cybercriminals were targeting “websites that offer instant online automobile insurance premium quotes” to steal driver’s license numbers. The NYSDFS recommended numerous data security measuring, including redacting PII on public facing websites entirely.

Notice of Unauthorized Access

On December 10, 2021 the Plaintiff received a notice from Travelers that an authorized party may have accessed her name, address, date of birth, and driver’s license by improperly using the credential of Travelers agaents to access Traveler’s agency portal. Interestingly, the Plaintiff maintains that she never applied for Travelers insurance on her own and is not a customer of Travelers.

Traveler’s insurance offered the Plaintiff and other class members complimentary identity theft and credit monitoring services for a 1-year period. However, the Plaintiff feels that this is not enough since she could face years of constant surveillance of their financial and personal records and that there are costs associated with possible future harm.

Judge Denies Traveler’s Motion to Dismiss

The Judge ruled that the class action should not be dismissed at this early stage and that the Plaintiff adquately alleged entitlement to the injunctive relief she seeks and her request for injunctive relief may proceed.
