LG Refrigerator Class Action Settlement

In an effort to resolve TCPA claims against them, LG has agreed to a class action settlement to pay consumers who purchased an LG refrigerator.

Case Background

In 2019, owners of LG refrigerators filed a case entitled: Bentley et al  v. LG Electronics U.S.A., Inc.  19-cv-13554 (D.N.J.).

Owners of LG refrigerators in New Jersey who purchased their units between January 1, 2014 and December 31, 2017 filed a class action against LG Electronics USA.

They alleged that their refrigerators either didn’t cool the food enough because of an inherent defect in the compressor or their refrigerators stopped cooling altogether. Some owners spent money to get their refrigerators repaired, some owners who suffered unsuccessful repairs of their refrigerators purchased replacements. All the owners suffered loss of property when the food and other food items inside their refrigerators spoiled. This case was brought in representation of all LG Refrigerator owners who suffered the similar problems with their LG refrigerators.

The LG refrigerator owners in this suit also alleged that despite their many complaints, LG Electronics did not stop manufacturing refrigerators with the defective compressors or selling them to consumers. They also alleged that no adequate warranty or repair service was made available for them.

What You Need to Prove to Collect Money In This Class Action

You must be able to prove that you purchased an LG refrigerator between January 1, 2014 and December 31, 2017.

You must also prove that your LG refrigerator broke down within 5 years of the date of purchase. You must prove that your refrigerator stopped cooling. You must prove that the food, medicine or other items stored in your refrigerator became spoiled. You must prove the cost of those items. You can also prove other losses related to the LG refrigerator failing to cool properly. For example, if because of the failure of your LG refrigerator to cool, the ice melted and your home suffered because of flooding, you can also make a claim for repairs to your house brought about by the flooding from the refrigerator leaking water.

You must file a claim using the form provided on the settlement website. You must also provide a personal statement of facts narrating all that happened to you when your LG refrigerator broke down. You must also provide proof of the costs to you. Providing documents detailing the losses you incurred and the costs of repair or replacement will allow you to get paid a higher amount.

How Much Can You Receive from the LG Settlement

If an LG Refrigerator owner filed a claim accompanied by a statement under oath, they may get up to $450.

The company is willing to pay up to $50 for every unsuccessful repair; up to $100 for out-of-pocket labor costs for repairs; up to $50 for delayed repairs; and up to $250 for food spoilage caused by the refrigerator’s cooling system bogging down.

With proof such as sales receipts to prove purchase, invoices or job orders for repair and cost of labor and parts, inspection records and insurance records, the company is willing to pay up to $1000 for unsuccessful repairs; $1000 for delayed repairs; up to $3500 for property loss and up to $650 if the owners paid for a replacement refrigerator.

  • You may file a claim until January 11, 2021.
  • If you have comments or objection to the proposed settlement, you can file your objection in writing until November 23, 2020.
  • If you do not want to be included in the settlement (as you want to file a separate action) you can also file an exclusion until November 23, 2020. On December 15, 2020, the District Court of New Jersey will decide whether to accept the proposed settlement.
